From July 26 until August 11, 2024 the Olympic and from August 28 until September 8, 2024 the Paralympic Games will take place in Paris. Allianz SE official partner of the event, is looking for the real fan, the ultimate Games supporter. A person who knows everything about the Games and the sports and is fully passionate about it. Allianz will invite this real fan for an exclusive trip to the 2024 Olympic Games and will produce a 2-3 minute film for its social and digital channels featuring this superfan before and during the event. 
1. Rules and regulations for participants:

1.1 By entering the program, the participant (hereinafter: “the Participant”) will accept these terms and conditions.

1.2. The participation in the program is possible for all Instagram users.

1.3 The raffle begins on Monday, January 29, 2024 at 15:00 hrs CET and ends on Sunday, February 18, 2024 at 23:59 hrs CET.

1.4 The Participant has to be at least 18 years old to take part in this program.

1.5 The Participant needs to post a maximum 90 second video on his/her Instagram account describing why he/she is the ultimate Games supporter. When posting the video the Participant needs to tag the Global Instagram Account of Allianz (Instagram) and add the hashtag #FanforReal.

1.6 When posting the video, the Participant shall consider his/her responsibility and make sure not to violate any rights of a third party, in particular if additional individuals are shown in the video. If these criteria are not met, Allianz SE is allowed to exclude persons from the raffle.

1.7 The posted video may be shown as part of the winner selection communication on internal Allianz communication channels. It may be considered for further internal and external communication. For any further communication purposes, the individual consent of the Participant will be collected.

1.8 One entry per person will be counted for the raffle. Allianz SE reserves the right to change, modify, end the competition or to exclude individuals from the competition if it appears someone is attempting to send multiple, automated entries or otherwise interfere with the competition.

2. Selection of winners

2.1 In a first step representatives of Allianz SE will shortlist up to five (5) Participants based on the following criteria: 1) Creativity of the video, 2) Passion for the Olympic & Paralympic Games, 3) Confidence in front of the camera, and 4) Communication skills.

2.2 The shortlisted Participants will be informed via Direct Mail on Instagram by Wednesday, February 21, 2024, including a proposal for a time slot for a video-call interview with representatives of Allianz SE.  The shortlisted Participants need to reply and confirm the interview within forty-eight (48) hours. Otherwise a substitute will be selected.

2.3 In a second step representatives of Allianz SE will conduct video-call interviews (max 30 minutes) with all short-listed Participants until Friday, March 1, 2024. Based on the interviews representatives of Allianz SE will select and inform one (1) final winner via Direct Mail on Instagram by Friday, March 8, 2024. The one (1) winner needs to reply and accept the prize within seventy-two (72) hours.

2.4 In the event of failing to respond within the given period, the winner loses his/her claim to the prize and another winner will be drawn. If a winner chosen is not able to use the prize (e.g. due to travel restrictions), the prize will be handed over to the next applicable winner.

2.5 The decision with regard to the submitters is final. Legal remedies are excluded. Should disputes arise in connection with the identity of a participant, a decision is made in favour of the holder of the Instagram account that was used to participate in this program. Should the submitters have transmitted incorrect information which makes further contact to said submitters impossible, the latter forfeits all and any prize won. In such case, a substitute will be selected.

3. Prizes

3.1. The one (1) winner will win a trip to the 2024 Olympic Games including:
 

  • Flights to Paris from an international airport of his/her choice (economy class), including food & beverage and access to Maison Allianz;
  • 3-night accommodation at the SO/Paris from August 2-5, 2024 (*****); and
  • Tickets to minimum 2 Olympic Games competitions, including “Swimming” on August 3 from 8:30pm-10:30pm.

3.2 The dates of the trip cannot be changed. The winner has the opportunity to stay longer in Paris on his/her own costs.

3.3 The prize cannot be assigned to third parties and cannot be paid out in cash. Conditions for tickets and the relating event are subject to the terms and conditions of the organizer. 

4. Content production

4.1 The winner is obliged to become the main protagonist featured in an Allianz video (the “Real Fan” episode) which will be part of a 10-epsiode content series of Allianz. In this content series Allianz will – together with the IOC and the IPC – accompany various protagonists how they prepare for the Olympic & Paralympic Games.

4.2 In order to produce the “Real Fan” episode the winner will work together with Allianz and its video production company BWGTBLD from April – August 2024 on a regular basis, specifically:

  • conducting at least 3 virtual interviews that will get recorded;
  • providing memories (photo or videos) from his or her former Olympic and/or Paralympic Games or qualifiers visits, or other events related to The Games; and
  • providing at least 5 self-recorded videos (with his/her own smartphone) describing how the winner is preparing for his/her trip to the Olympic Games, his/her excitement, his/her memories about the Games, etc.

Last but not least the winner will get accompanied by a video team of BWGTBLD for one day during his/her stay in Paris.

When producing this content, the winner need to cohere with the IOC/IPC and Allianz guidelines, i.e. they might be asked to wear specific, unbranded clothing.

All materials together will be used to edit the Real Fan episode (a 2-3 minute video, plus various shorter versions, so called “cut downs”).

4.3 The Real Fan episode and all related cut downs will be published on social and digital channels of Allianz, the IOC and the IPC. This requires that the winner and Allianz SE enter into a separate influencer agreement under which the communication rights of Allianz SE and its affiliates, the IOC and the IPC are set out.

4.4 In the event of failing to enter into the agreement as set out under clause 4.3 above within a reasonable period of time, the winner loses his/her claim to the prize and another winner will be chosen by Allianz SE.

4.5 Another element to your “Real Fan” engagement could be a social takeover of Allianz’ social media channels while being at the Olympic Games in Paris, providing Allianz’ community with some behind-the-scenes views from the Games. 

5. Grant of rights and representations

5.1 Participant hereby grants Allianz SE and its affiliated companies the non-exclusive, worldwide, perpetual, royalty-free, fully paid-up right, license and permission to display, post, publish, distribute, exhibit, reproduce, modify and/or otherwise use the picture and the Participant’s name, likeness, handle, and text in connection with such video (collectively, the “Content”) on Allianz SE websites, microsites and social media properties, including but not limited to Allianz’ verified/official pages on Facebook, Twitter, Instagram, Vimeo, Google+, YouTube and/or Flickr (collectively, the “Websites”), for marketing, trade, advertising, promotional, public relations or any other purposes. The Participant agrees that it shall have no right of approval and no claim to compensation arising out of any use (in accordance with the terms hereof), alteration, editing, distortion, faulty reproduction, or use in any composite form of the Content. The Participant irrevocably and voluntarily waive any and all “moral rights” the Participant may have in the Content.
 

5.2. By posting the video, the Participant states that:

  • (a) she/he is at least 18 Years old;
  • (b) she/he is the sole creator of the video and has the right to grant the rights under these terms and conditions,
  • (c) the video does not violate any applicable laws or regulations;
  • (d) the video does not infringe the intellectual property rights of any third party;
  • (e) the Participant has not granted or transferred any rights in or to the concept to any third party prior to the date of submission; 
  • (f)  the Content does not contain any content that is inappropriate, indecent, obscene, hateful, tortious, defamatory, insulting, bullying, slanderous, or libelous or otherwise depicts inappropriate behavior or physical injury or death to living beings; and
  • (g) you have a written privacy release(s) from any and all individuals appearing in the video.

 

5.3 The Participant agrees to indemnify and hold Allianz SE and its affiliated companies harmless from and against any and all claims, actions or proceedings of any kind and further from any and all damages, liabilities, costs and expenses (including but not limited to reasonable attorneys’ fees) relating to or arising out of any breach or alleged breach of any of my warranties, representations or agreements hereunder.

6.2 Participant fully releases, waives and discharges, and covenants not to sue, Allianz SE (including but not limited to members, managers, employees, representatives, or agents) from and for any and all demands, claims, actions, suits, damages, losses, liabilities, costs and expenses (including, but not limited to court costs and attorneys’ fees), from any cause whatsoever (including, but not limited to, travel delays, property damage and loss, bodily injuries, sickness, disease and death), directly or indirectly arising in connection with the Participant’s participation in the raffle, whether or not foreseeable or contributed to by the negligent acts or omission of Allianz SE.

Allianz SE and its affiliates will not accept any liability for losses to property or for financial losses which may arise in connection with participation in the raffle.

This does not apply to losses, which Allianz SE or any of its affiliates have caused by intent or gross negligence. The liability exclusion clause does not apply to losses which are attributable to a breach of material contractual duties on the part of Allianz SE or its affiliates – even if this only constitutes slight negligence – but which is indispensable for achieving the purpose of the agreement (so called "cardinal duties") as long as these are losses which are typical of this type of agreement and which are foreseeable.

This shall have no effect on liability under the Product Liability Act or liability for culpable injury to life, the body and health.

The above liability limitations also apply to the benefit of the legal representatives, employees and other vicarious agents of Allianz SE and its affiliates

7. Jurisdiction, Venue, Severability 

7.1 The Terms and Conditions are subject to the laws of the Federal Republic of Germany excluding the provisions of German private international law.

7.2 The courts of Munich shall have exclusive jurisdictions for any disputes arising out of or in connection with this Terms and Conditions.

 

7.3 In the event that any provision of these terms is held unenforceable, the validity or enforceability of the remaining provisions will not be affected, and the unenforceable provision will be replaced with an enforceable provision that comes close to the intention underlying the unenforceable provision. 7.4 These general terms and conditions can be changed by Allianz SE at any time without separate notification.

8. Data Privacy

8.1 Allianz SE collects, processes, uses and stores the competition participants' data provided for the purpose of selecting a winner. Once the winner is selected, personal data and video recordings of the winner will be collected, used and processed for the promotional activities as described in the above sections.  The participants’ data will not be used for other purposes by Allianz SE without the express consent of the Participant.

8.2 All personal data of the Participant will be processed and used by Allianz SE in accordance with applicable law.
